View Photography – Drone Photography/Videography Services Terms & Conditions
1. Acceptance of Terms
By engaging the services of View Photography for drone photography/videography and other drone requested activities, the client agrees to be bound by these terms and conditions.
2. Services Provided
View Photography will provide aerial photography and videography services using unmanned aerial vehicles (UAVs or drones). The scope of services will be as agreed upon in writing between View Photography and the client.
3. Compliance with Laws and Regulation
View Photography agrees to operate the drones in compliance with all applicable laws and regulations in Australia related to drone usage, including but not limited to the Civil Aviation Safety Regulations (CASR) and the drone safety rules specified by the Civil Aviation Safety Authority (CASA).
4. Insurance
View Photography carries public liability insurance covering its drone operations. In the event of any damage or injury caused by the drone during the provision of services, View Photography will take appropriate steps to address the situation and coordinate with the client.
5. Client Responsibilities
The client is responsible for obtaining any necessary permits or permissions and any costs incurred for the drone services required, especially if the project involves flying in restricted areas or near sensitive locations. The client is also responsible for ensuring the safety of individuals present during the drone operations. This will involve liaising with the drone operator to comply with all relevant regulations applying to the required flight operations to be undertaken.
6. Payment Terms
Payment for services must be made as agreed upon for the contracted price between View Photography and the client. The full amount will be required before the commencement of services.
7. Cancellation and Rescheduling
The client may cancel or reschedule services by providing View Photography with 21 days’ written notice. However, a cancellation fee of the full deposit plus any other costs borne by View Photography above the amount covered by the deposit will apply if the cancellation is made within 7 days before the scheduled service date.
If View Photography is unable to attend due to circumstances beyond its control in the 1st instance it will organise another booking time agreeable to both parties or if unable to come to an agreement, then View Photography will refund the entire deposit.
8. Copyright and Usage Rights
View Photography retains the copyright to all photographs and videos produced during the drone services. The client is granted a non-exclusive license to use the content for the intended purpose outlined in the agreement. Any additional usage beyond the agreed scope may require written permission and may incur additional fees.
View Photography may use any footage gathered for its promotional purposes and the client agrees to release View Photography from any claims for using the footage in any way it deems appropriate in any form.
9. Confidentiality
Both parties agree to keep any confidential information shared during the course of the services confidential and not to disclose it to third parties without the written consent of the other party.
10. Limitation of Liability
View Photography shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the services provided, even if View Photography has been advised of the possibility of such damages.
11. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Australia. Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Australian courts.
12. Changes to Terms and Conditions
View Photography reserves the right to modify these terms and conditions at any time. Clients will be notified of any changes, and the updated terms will apply to all future engagements.
By engaging the services of View Photography, the client acknowledges that they have read, understood, and agreed to these terms and conditions.
